Terms of Service

1. Acceptance of Terms

By accessing or using RateMyImmigration ("the Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. We reserve the right to update these Terms at any time, and continued use of the Platform constitutes acceptance of any changes.

2. Description of Service

RateMyImmigration is a review and directory platform that allows individuals to share their experiences with immigration consultants (RCICs) and immigration lawyers in Canada. We do not provide immigration advice, legal services, or official assessments of any professional.

We are not affiliated with the College of Immigration and Citizenship Consultants (CICC), the Canadian Immigration Lawyers Association (CILA), Immigration, Refugees and Citizenship Canada (IRCC), or any government body.

3. User Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this requirement and that all information you submit is accurate.

4. User Accounts

Certain features of the Platform may require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access or use of your account at [email protected].

We reserve the right to suspend or terminate any account that violates these Terms.

5. Reviews and User-Generated Content

When you submit a review or any content to the Platform, you represent that:

• You have a genuine, first-hand experience with the consultant being reviewed.
• All information provided is truthful and accurate to the best of your knowledge.
• You are not submitting the review in exchange for payment, reward, or on behalf of another party.
• Your content does not contain harassing, defamatory, obscene, or unlawful material.

By submitting content, you grant RateMyImmigration a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content on the Platform. We reserve the right to edit, moderate, or remove any content that violates these Terms or our Review Policy.

6. Prohibited Conduct

You agree not to:

• Post fake, misleading, or manipulated reviews.
• Solicit or incentivize others to post reviews.
• Harass, threaten, or intimidate any user, consultant, or staff member.
• Scrape, crawl, or systematically extract data from the Platform without written permission.
• Attempt to gain unauthorized access to any portion of the Platform.
• Use the Platform for any unlawful or fraudulent purpose.
• Impersonate any person or entity.

7. Consultant Profiles

Immigration professionals listed on RateMyImmigration may claim their profiles. By claiming a profile, the professional agrees to:

• Provide accurate professional information, including license numbers and credentials.
• Not attempt to suppress, manipulate, or fraudulently remove legitimate reviews.
• Respond to reviews in a professional and respectful manner.
• Comply with applicable professional codes of conduct (CICC, provincial law societies, etc.).

8. Subscription Plans & Billing

RateMyImmigration offers subscription plans ("Plans") for immigration professionals who wish to access lead generation and premium features. The current Plans and pricing are displayed on the Pricing Page.

• Billing: Subscriptions are billed monthly in advance. You authorize us to charge your payment method on a recurring basis until you cancel.
• Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for unused time within a billing cycle.
• Failed Payments: If a payment fails, your subscription may be downgraded or suspended until the outstanding balance is resolved.
• Price Changes: We reserve the right to change Plan pricing with 30 days' advance notice by email. Continued use after the change takes effect constitutes acceptance of the new pricing.
• Taxes: Prices displayed are in Canadian Dollars (CAD) unless otherwise stated. You are responsible for any applicable taxes in your jurisdiction.

Subscriptions are processed through Stripe. By subscribing, you also agree to Stripe's Terms of Service.

9. Lead Purchase Terms

Subscribers on eligible Plans may purchase access to prospective client leads ("Leads") through the Platform. By purchasing a Lead, you acknowledge and agree:

• All Sales Final: Lead purchases are non-refundable except as provided in our Lead Policy.
• No Guarantee of Success: We do not guarantee that any Lead will result in a client engagement, consultation, or conversion. Contact details are provided' as collected and are not independently verified.
• No Guarantee of Accuracy: Lead information is submitted by prospective clients and may contain errors, inaccuracies, or incomplete data. We are not responsible for incorrect information provided by users.
• Limited Replacement Eligibility: A replacement Lead may be requested only if contact information is demonstrably invalid (e.g., phone disconnected, email bounces), submitted within 24 hours of purchase, and supported by evidence. Non-response, disinterest, or budget mismatch do not qualify. See our Lead Policy.
• Prohibited Use of Lead Data: Lead contact information may only be used for the purpose of following up on the specific immigration enquiry submitted by the prospective client. You may not sell, share, or use Lead data for unrelated marketing purposes.
• Compliance: You are solely responsible for ensuring your outreach to Leads complies with applicable anti-spam, telemarketing, and privacy laws (including CASL where applicable).

10. Rankings & Visibility

Consultant rankings, search placement, and visibility on the Platform are determined by a combination of factors including, but not limited to: review scores, number of reviews, recency of activity, profile completeness, and subscription status.

We reserve the right to modify ranking algorithms and visibility criteria at any time. Sponsored and premium Plan subscribers may receive enhanced visibility as part of their Plan benefits; this is clearly disclosed on the Platform.

We do not guarantee any specific search placement or lead volume as a result of subscribing to any Plan.

11. Verified Badges & Credentials Disclaimer

We offer optional badge designations (e.g., "License Verified", "Identity Verified") as a convenience to help users evaluate professionals. These badges are based on documentation submitted to us and reviewed by our team; they do not constitute legal professional certification, endorsement, or guarantee of fitness for any immigration matter.

We are not affiliated with the College of Immigration and Citizenship Consultants (CICC) or any regulatory body. A badge on our Platform does not replace the obligation to independently verify a consultant's standing with the relevant regulatory authority before engaging their services.

12. No Professional Advice

Nothing on this Platform constitutes immigration, legal, financial, or professional advice. All content — including reviews, ratings, and profile information — is for informational purposes only. Always conduct your own due diligence before engaging any immigration professional.

13. Intellectual Property

All Platform content, design, logos, and software are the intellectual property of RateMyImmigration or its licensors. You may not reproduce, modify, or distribute any Platform material without prior written consent.

14. Third-Party Links

The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any external site. Links do not constitute endorsement.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

16. Limitation of Liability

To the fullest extent permitted by applicable law, RateMyImmigration, its directors, employees, and operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost data, loss of goodwill, or business interruption — arising from:

• Your use of, or inability to use, the Platform or its content;
• Any review, rating, or content posted by a third party;
• A Lead that contains inaccurate, incomplete, or false contact information;
• Failure of a purchased Lead to respond, convert, or engage;
• Any outcome of immigration proceedings, applications, or decisions;
• Unauthorized access to or alteration of your transmissions or data;
• Any other matter relating to the Platform,

even if we have been advised of the possibility of such damages. Our aggregate liability for all claims relating to the Platform shall not exceed the greater of (a) the total fees you paid to us in the 3 months preceding the claim, or (b) CAD $100.

17. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada. Any disputes shall be resolved in the courts of British Columbia.
